This document sets out the terms of use and the privacy policy that apply to the Purple Shirt CX Maturity Assessment (the assessment), an online self assessment tool operated by Purple Shirt Limited (Purple Shirt, we, us or our) to help organisations understand their customer experience maturity.
By starting the assessment and submitting your details, you confirm that you have read and accepted these terms of use and that you understand how we handle your personal information as described in the privacy policy below. If you do not agree, please do not use the assessment.
These terms are governed by the laws of New Zealand, including the Privacy Act 2020. Purple Shirt Limited is a New Zealand company based in Auckland.
The assessment is provided for general informational and educational purposes. It generates an indicative view of your organisation's customer experience maturity based on the responses you give. It is a guide to prompt discussion and reflection, not a formal audit, certification, or professional advisory service.
Your use of the assessment is subject to these terms. We may update them from time to time, and the version published or presented at the time you take the assessment is the version that applies to your use.
The assessment is intended for people using it in a work or business context. By providing details about the organisation you work for, you confirm that you are authorised to do so and that the information you provide is accurate to the best of your knowledge.
You are responsible for the accuracy of the information and responses you submit. Because the results are generated from your responses, the quality and relevance of the output depends on the accuracy and honesty of the answers you give.
Results are shown to you on screen at the end of the assessment and a copy may be emailed to the work email address you provide. Results are indicative and are provided on an as is basis. They do not constitute professional, legal, financial, or business advice, and should not be relied on as the sole basis for any decision. You should seek tailored advice before acting on the output.
Purple Shirt owns, or has the right to use, all content, design, methodology, scoring, and materials that make up the assessment and the results it produces. You may use your own results for your internal business purposes. You may not copy, reproduce, adapt, distribute, or commercialise the assessment, its methodology, or its outputs without our prior written permission.
We aim to keep the assessment available and working as intended, but we do not warrant that it will be uninterrupted, error free, or secure at all times. We may change, suspend, or withdraw the assessment, in whole or in part, at any time without notice.
To the maximum extent permitted by law, Purple Shirt is not liable for any loss or damage, whether direct or indirect, arising from your use of the assessment or your reliance on its results. Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded. Where you use the assessment for business purposes, you agree that the Consumer Guarantees Act does not apply.
These terms are governed by New Zealand law, and you submit to the non exclusive jurisdiction of the New Zealand courts.
This privacy policy explains how Purple Shirt collects, uses, stores, and protects the personal information you provide when you use the CX Maturity Assessment. We handle personal information in accordance with the Privacy Act 2020 and the information privacy principles set out in that Act.
Through the assessment we collect a limited set of personal information: your name, your work email address, your position or job title, and the name of the organisation you work for. We also collect the responses you provide during the assessment. We may collect basic technical information such as your browser type or device information where this is needed to operate the tool.
We collect this information directly from you when you complete the assessment. We collect it so that we can generate and display your results, email you a copy of your results, understand the maturity of the organisations that use the assessment, and, where relevant, contact you about your results and about Purple Shirt services that may be of interest. Providing your details is voluntary, but if you choose not to provide them we may not be able to give you your results.
We use your personal information only for the purposes for which you provided it, or for closely related purposes you would reasonably expect, or as otherwise permitted under the Privacy Act 2020. This includes generating and delivering your results, responding to your enquiries, and improving the assessment. We may produce aggregated and de identified insights about customer experience maturity, but these do not identify you or your organisation.
Where appropriate, we may use your work email address to follow up about your results or to share related Purple Shirt content and services. You can opt out of these communications at any time by using the unsubscribe option in the message or by contacting us using the details below. We will not sell your personal information.
Purple Shirt operates and holds the assessment data itself. We generally do not share your personal information with third parties, except with trusted service providers who help us operate our systems and who are only permitted to use the information to provide those services to us. We may disclose information where we are required to do so by law, and we will use reasonable efforts to let you know beforehand unless we are legally prevented from doing so.
We take reasonable steps to keep your personal information secure and to protect it from loss, misuse, unauthorised access, modification, or disclosure. Access is limited to those who need it to carry out the purposes described in this policy.
We keep your personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law. When it is no longer needed, we will securely delete or de identify it.
Under the Privacy Act 2020 you have the right to ask for a copy of the personal information we hold about you and to ask us to correct it if it is wrong. To make a request, contact us using the details below. We will respond as soon as reasonably practicable and within the timeframes required by the Act.
If a privacy breach occurs that we assess as likely to cause serious harm, we will notify the Office of the Privacy Commissioner and any affected individuals as required by the Privacy Act 2020.
If you have a concern about how we have handled your personal information, please contact us first so we can try to resolve it. If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner at www.privacy.org.nz.
We may update this privacy policy from time to time to reflect changes in our practices, technology, or the law. The current version will be made available wherever the assessment is offered, and changes take effect once published.
